1. Who we are

PlanCutFit is operated by PlanCutFit (“PlanCutFit”, “we”, “us”). We can be contacted at legal@plancutfit.com.

2. The service

PlanCutFit is a software-as-a-service platform for flooring businesses, providing a visual floor planner and measuring tool, material and roll-waste calculators, CRM and lead management, quoting, scheduling, a customer portal, invoicing, an offline/field app, a free lead-capture website, and related tools (“the Service”). Features available to you depend on your subscription plan.

3. Accounts

• You must provide accurate registration information and keep it up to date.
• You're responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must be at least 18 years old and have authority to bind the business you register on behalf of.
• Notify us immediately at legal@plancutfit.com if you suspect unauthorised access to your account.

4. Subscriptions, billing, and free trial

• PlanCutFit is offered on paid monthly subscription plans (currently Sole Trader and Shop, with optional extra seats), billed in advance via Stripe. Current pricing is shown at plancutfit.com/#pricing.
• New accounts get a 7-day free trial. No card charge occurs until the trial ends and you actively subscribe, unless stated otherwise at signup.
• Subscriptions renew automatically each billing period until cancelled. You can cancel at any time from Settings → Billing; cancellation takes effect at the end of the current billing period, and we don't provide pro-rata refunds for the unused portion of a period except where required by law.
• We may change plan pricing or features with reasonable advance notice. Continued use after a price change takes effect constitutes acceptance of the new price.
• Failure to pay may result in reduced (“read-only”) access or suspension of your account until payment is resolved.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in breach of any applicable law or regulation
• Attempt to reverse-engineer, decompile, or gain unauthorised access to the Service or its underlying code or infrastructure
• Scrape, resell, sublicense, or provide access to the Service to third parties outside your organisation without our written consent
• Upload content you don't have the right to use, or content that is unlawful, infringing, or harmful
• Interfere with or disrupt the integrity or performance of the Service, including via excessive automated requests
• Use the Service to store or process data for anyone other than your own business and its customers, unless agreed with us in writing

We may suspend or terminate accounts that breach this section.

6. Your data and your responsibilities as a controller

You retain ownership of the Customer Data you input into PlanCutFit (your leads, customers, jobs, quotes, invoices, photos, and floor plans). As between you and us, you are the data controller of that data, and PlanCutFit processes it on your instructions as a processor, as described in our Privacy Policy. You're responsible for:

• Having a lawful basis to collect and process your customers' personal data
• Giving your customers any privacy notices required by law
• The accuracy of the data you enter
• Only uploading floor plan images, photos, or documents you have the right to use, including when using AI-assisted detection features that send images to a third-party AI provider (see Section 8 and our Privacy Policy)

7. AI-assisted features — accuracy disclaimer

Floor plan detection, sketch recognition, price-list parsing, and other AI-assisted estimates are provided as a convenience to speed up your workflow. They are approximations generated by third-party AI models and are not guaranteed to be accurate. You must independently verify all measurements, room dimensions, material quantities, and pricing on site before ordering materials, scheduling work, or issuing a final quote. PlanCutFit is not liable for losses arising from reliance on unverified AI-generated estimates.

8. Third-party services

The Service integrates with third-party providers, including Stripe (payments), OpenAI (AI features), Google (maps, analytics, sign-in), PostHog (analytics), Resend (email), Twilio (SMS), and optional accounting integrations (Xero, QuickBooks, FreeAgent, Sage) that you may choose to connect. Your use of those integrations may also be subject to that provider's own terms. We are not responsible for the availability, performance, or acts or omissions of third-party providers.

9. Payments you take from your own customers

If you connect Stripe Connect to accept payments from your customers through PlanCutFit (e.g. via the customer portal), you are the merchant of record for those transactions and are responsible for your obligations to your customers, including refunds, disputes, and compliance with consumer protection law. PlanCutFit is not a party to those transactions and is not responsible for payment disputes between you and your customers.

10. Intellectual property

PlanCutFit and its licensors own all rights, title, and interest in the Service, including its software, design, trademarks, and content (excluding your Customer Data). We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these terms for the duration of your subscription. You may not copy, modify, or create derivative works of the Service outside that licence.

11. Availability

We aim to keep the Service available and reliable, including offline functionality for the field app, but we don't guarantee uninterrupted or error-free operation. We may perform maintenance, and features may change as the product evolves. We are not liable for unavailability caused by factors outside our reasonable control, including third-party provider outages or your own internet connectivity.

12. Limitation of liability

To the maximum extent permitted by law: the Service is provided “as is” and “as available” without warranties of any kind, express or implied. PlanCutFit shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunity, arising from your use of the Service. Our total liability arising out of or relating to these terms or the Service is limited to the amount you paid us in the 12 months preceding the claim. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

13. Indemnification

You agree to indemnify and hold PlanCutFit harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of the Service, or your violation of any law or third-party right, including in relation to Customer Data you process using the Service.

14. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your account if you materially breach these terms (including non-payment or breach of the acceptable use section) and don't remedy the breach within a reasonable period after notice, or immediately for serious breaches, fraud, or unlawful use. On termination, your right to access the Service ends; we'll retain your data for the period described in our Privacy Policy to allow for export and to meet legal obligations.

15. Changes to these terms

We may update these terms from time to time. We'll notify you of material changes in-app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

16. Governing law

These terms are governed by the laws of England and Wales. Any dispute arising from these terms or the Service will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protections that apply in your country of residence.
